The contracting parties are you (model) and I (photographer). The contract applies immediately upon written agreement by both of us in writing for instance by email or IM

When agreeing to a shoot with me, my terms and conditions supersedes and replaces in their entirety any other terms and conditions, including your standard terms.

Any changes to my terms and conditions must be agreed in writing before agreeing to shoot with me

The purpose of the contract is for the engagement of you as a model for a shoot

The exact date, start time and length of the shoot will be agreed in writing by email or IM in due time before the shoot starts

Only by mutual agreement may the shoot be extended on the day. If extended, I will pay you your hourly rate per started hour.

I may cut the shoot short by paying you the full agreed fee for the agreed shoot

You are expected to perform your own hair and makeup, unless otherwise agreed beforehand. I will give you appropriate time (up to 30 minutes) within the agreed time to put on your hair and makeup, and I will give you appropriate time (up to 15 minutes) to remove your makeup and get ready for your next shoot.

Your ready-time is therefore +30 minutes after the start of the shoot, and your end-time is -15 minutes before the end of the shoot. This for instance leaves 2:15 hours of a 3-hour shoot for effective shooting

Unless otherwise agreed in writing before the start of the shoot, the shooting style will be artistic nude. By artistic nude is meant the deliberate portrayal of the human body for aesthetic, emotional and anatomical purposes. The primary focus is on form, lighting, composition, and artistic expression. Artistic nude includes the category of fine-art nude and bodyscape photography.

Only if agreed in writing before the shoot, the shooting style may extend to open leg style and shibari work.

The specific theme of the shoot will be agreed in due time before the shoot, for instance by exchanging mood board or example photos

During the shoot I may record both still images (“photos”) and video. This includes behind-the-scenes video of the shooting area.

No still images or video will be recorded of outside the shooting area

As a model you will be compensated for your services in accordance with the agreed upon rates. The payment will be made as a lump-sum payment upon the completion of the services at the end of the shoot.

We will both respect each other’s time and schedule.

If, for whatever reason, I need to cancel an agreed booking, I will pay you a cancellation fee depending upon when the booking is cancelled and if you are a traveling model or not:

For traveling models, i.e. models who are not normally residing in Denmark:

• If the booking is cancelled at least 30 days before the date and start time of the shoot, I will pay you a cancellation fee equal to 50% of the agreed booking fee for the agreed time.

• If the booking is cancelled after 30 days before the date and start time of the shoot I will pay you a cancellation fee equal to 100% of the agreed booking fee for the agreed time.

For non-traveling models, i.e. models who are normally residing in Denmark:

• If the booking is cancelled at least 30 days before the date and start time of the shoot, I will pay you a cancellation fee equal to 25% of the agreed booking fee for the agreed time.

• If the booking is cancelled after 30 days before the date and start time of the shoot I will pay you a cancellation fee equal to 50% of the agreed booking fee for the agreed time.

If, for whatever reason, you need to cancel an agreed booking, you will pay me a cancellation fee depending upon when the booking is cancelled:

• If the booking is cancelled at least 14 days before the date and start time of the shoot, you will pay me a cancellation fee equal to 0% of the agreed booking fee for the agreed time.

• If the booking is cancelled after 14 days before the date and start time of the shoot, you will pay me a cancellation fee equal to 25% of the agreed booking fee for the agreed time.

Any copyrightable works, images, video, product or other information (collectively called the “work product”) developed wholly or partly in connection with the shoot is the exclusive property of me as the photographer. This includes all distribution and publication rights.

Upon request you may be given a limited right to publish parts of the work to your model portfolio.

It is the sole discretion of me to choose the images and video to edit and in what style

You are responsible for arranging transportation to and from the studio or location. The transportation time is outside the agreed timeslot for the shoot, and thus you need to make sure to have enough time between shoots to make it in time for the start of the shoot.

I will pay you the equivalent cost for transportation from where you stay in Denmark to and from the studio or location using public transportation

When shooting in my studio, it is important that it is a safe space for you. If there is anything which makes you uncomfortable or uneasy, please speak up immediately.

I will be the only photographer there - unless clearly agreed before the shoot that additional photographers may be present.

If agreed, I may have either hair & makeup and/or stylists present for the shoot.

In my studio you will find a dedicated space for putting on your makeup, and where you may leave your things during the shoot. There will be a space for changing clothes, as well as access to toilet facilities. I do not have access to bathing facilities.

You will find bottled water in the studio and normally I will also have some snacks etc. available for you. If you need anything special please let me know in good time before the shoot.

In my studio, I shoot with a screen which shows every image captured. You will therefore be able to see every angle and zoom, and can follow the shoot to confirm that it stays within the agreed theme and shooting styles. I will also use the screen as part of my direction of you to illustrate how I want you to model

When shooting at location, I am less in control of the environment, but I will make any possible change you feel is necessary for your safety and security during a shoot. I will not risk your safety of security for a shoot, and I may therefore also reject modelling ideas if I don’t think they are safe (for instance modeling in water or with risk of falling etc.)

When shooting on location, there will generally not be access to a dedicated spaces for neither makeup nor changing. You are expected to be OK with changing in public, but I will try to arrange for your to change in as much privacy as possible.

I will bring bottled water and normally I will also have some snacks etc. available for you. If you need anything special please let me know in good time before the shoot.

When shooting on location I don’t have access to a separate screen to show the images to you. I will instead show you example images on the camera during the shoot.

You are expected to arrive well-rested for the shoot, and ready to shoot at the ready-time (normally 30 minutes after the start time of the shoot).

During the shoot you are expected to communicate clearly with me if there is anything you need.

During the shoot I will direct you on how I would like you to model, but I will give you space to and encourage you to express your own artistic view.

I will newer touch you during a shoot, unless clearly articulated and agreed. This includes touching your hair, clothes or any part of your body.

Both you and I will keep any information proprietary to the other as strictly confidential. This includes names, adresses, phonenumbers and other personal indentifiable information (PII), as well as any other personal or business secret learned before, during or after the shoot.

This confidentiality extends beyond the contract.

I will make every possible attempt to avoid injuries, loss of property or other damages before, during and after a shoot.

You are expected to have insurance for any injuries, loss of property and other damages occurring before, during or after a shoot, and you waive any right to seek reparations from me and any legal entity associated with me for any injuries.

You agree to indemnify and hold me harmless for any claim, losses, expenses, fees including attorney fees, cost and judgements that may be assessed agains me as a result of your shoot.

The terms and conditions are governed by Danish law
